Just crashed in an 08 Mitsubishi Lancer with side airbags, but NONE of the deployed! can i sue?

I don't believe you can sue air bag manufacturers any more. My godfather was knocked off an overp in houston by an 18-wheeler into oncoming traffic and flipped end over end 12 times...no airbag deployment. He was able to sue but this was back in like 95. Since then they have ped laws or something stating that in the event of a crash many things can cause the airbags to malfunction and not deploy therefore releasing the manufacturer of any liability.
